These Terms and Conditions are between you and Allie Cline Photography (“Company,” “we,” “us”). They govern your use of alliecline.com and any inquiry, booking, photography services, products, and digital files provided by Allie Cline Photography.
By using the website, submitting an inquiry, booking a session, signing a proposal or contract, paying an invoice, or participating in a session, you agree to these Terms.
Website use and eligibility
You must be 18 years or older to book services. If you are booking for a minor, you represent that you are the parent or legal guardian and may consent on the minor’s behalf.
We may update the website and these Terms at any time. Continued use means you accept the updated Terms.
Privacy
Your use of the website is subject to our Privacy Policy. If you do not have a Privacy Policy page yet, you should add one since you are collecting names, emails, phone numbers, and session details.
Booking and session agreement
A session is not reserved until we receive both:
Your invoice, proposal, session guide, or contract may include additional terms that apply to your booking. If those conflict with these Terms, the signed contract terms control for that specific booking.
Payments and pricing
Prices are subject to change at any time, but your booked pricing is honored as stated in your booking documents.
Unless otherwise stated in writing:
If a payment is returned or fails, you are responsible for any processing or bank fees and timely replacement of payment.
Cancellations, reschedules, and no shows
If you need to reschedule, notify us as soon as possible. Reschedules are subject to availability.
Unless we state otherwise in your booking documents:
We reserve the right to cancel and refund if we cannot provide services due to illness, emergency, safety concerns, severe weather, or circumstances beyond our control. In that case, our liability is limited to the amounts you have paid.
Weather and force majeure
Outdoor sessions are weather dependent. If weather conditions are unsafe or likely to significantly impact quality, we will reschedule.
We are not responsible for delays or failure to perform due to events outside our reasonable control, including severe weather, natural disasters, travel interruptions, power outages, government actions, venue closures, or illness.
Client responsibilities

We are not responsible for compromised coverage due to lateness, uncooperative subjects, location restrictions, venue rules, or interference from guests.
Creative style and artistic discretion
You are hiring us for our style and artistic judgment. This includes posing, composition, lighting, and the editing approach.
Editing choices, including color, black and white conversions, skin smoothing, and minor retouching, are at our discretion unless otherwise agreed in writing. We do not guarantee replication of any specific image outside our portfolio.
Unedited raw files are not delivered.
Image selection and delivery timelines
Delivery timelines vary by season and are provided in your booking documents or client guide. Delivery timelines are estimates, not guarantees, and may be affected by circumstances outside our control.
We recommend you download and back up your digital files promptly. We are not obligated to store images indefinitely.
Products, albums, wall art, and design
If you order printed products, wall art, albums, or frames:
If you choose to print elsewhere, we cannot guarantee print quality. No digital files shall be printed unless otherwise agreed upon in writing.
Copyright and permitted use
All photographs and materials created by Allie Cline Photography are protected by copyright law. We retain copyright to all images.
If you purchase digital files, you receive a personal use license to:

Commercial and special use licensing is available upon request.
Model release and marketing use
Unless you opt out in writing before the session, you grant us permission to use the images for our portfolio, website, social media, studio samples, publications, and marketing.
Opting out does not affect the quality or scope of your session, but it may limit promotional incentives if any are offered.
If you do not want certain images shared, tell us in writing as early as possible and no later than image selection.
Third party sharing and social media
If you tag us or share images online, you understand that online platforms may change image quality and apply compression. We are not responsible for unauthorized use by third parties once images are publicly posted.
Safety
We will not perform work in unsafe conditions. Clients and guests must follow instructions related to safety and location rules. We may end the session if conditions are unsafe or if behavior is threatening, abusive, or inappropriate. In that case, fees are not refunded.
Limitation of liability
To the fullest extent permitted by law, the Company is not liable for:
If the Company is found liable for any claim, our total liability is limited to the amount you paid to the Company for the session that gave rise to the claim.
Substitutions and equipment failure
We maintain professional equipment and backups. In the rare event of equipment failure, data loss, or circumstances that prevent delivery, we will attempt reasonable remediation, which may include rescheduling. If images cannot be delivered, your remedy is limited to a refund of amounts paid for that session.
Dispute resolution
We prefer to resolve issues directly and respectfully. You agree to contact us first and allow a reasonable opportunity to address concerns.
If a dispute cannot be resolved informally, the parties agree to attempt good faith mediation before filing a lawsuit, unless an emergency court order is needed.
Governing law and venue
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of laws rules. Any legal action must be brought in a court of competent jurisdiction in North Carolina, unless the parties agree otherwise in writing.
Severability
If any part of these Terms is found invalid or unenforceable, the remaining sections remain in full force and effect.

Unless otherwise stated in writing:
- retainers and session fees are non refundable
- product orders and digital files are non refundable once purchased
- payment plans must remain current to receive products or digital files
If a payment is returned or fails, you are responsible for any processing or bank fees and timely replacement of payment.
Cancellations, reschedules, and no shows
If you need to reschedule, notify us as soon as possible. Reschedules are subject to availability.
Unless we state otherwise in your booking documents:
- cancellations forfeit the retainer session fee
- no shows forfeit the retainer session fee and may require a new session fee to rebook

- arriving on time
- communicating key details, goals, and any must have groupings
- supervising children and ensuring their safety during the session
- securing permissions for locations where required
- disclosing any behavioral, sensory, medical, or accessibility needs that affect the session experience

- colors may vary between screens and print labs
- you are responsible for selecting from the range of materials offered, but photographer is responsible for final designs and crop choices
- once an order is placed, it cannot be canceled or refunded
If you choose to print elsewhere, we cannot guarantee print quality. No digital files shall be printed unless otherwise agreed upon in writing.
Copyright and permitted use
All photographs and materials created by Allie Cline Photography are protected by copyright law. We retain copyright to all images.
If you purchase digital files, you receive a personal use license to:
- download and view
- share online for personal use with credit when reasonably possible
- make personal gifts for family, printing not to exceed 5x7"
You may not, without written permission:
- sell images or use them for commercial purposes
- enter images into contests on behalf of the Company
- edit, apply filters, alter color, or crop in a way that misrepresents our work, to include the use of AI on the images
- remove watermark if one is applied to previews
- claim the work as your own
- give files to vendors for advertising or publication
Commercial and special use licensing is available upon request.
Model release and marketing use
Unless you opt out in writing before the session, you grant us permission to use the images for our portfolio, website, social media, studio samples, publications, and marketing.
